Mitigation is information provided to resolve a case fairly, according to Weinberg. A 402 hearing is a proceeding where a judge tries to find common ground between all parties to settle a case to the satisfaction of all, according to Illinois Supreme Court Rules. It is an off-the-record discussion in the judge’s chambers.

The case was continued until 9:30 a.m. July 6 in the Skokie branch of the Circuit Court of Cook County for the possible 402 conference and other matters the parties may discuss.
