Niles' Complaints Dismissed in Water Lawsuit with Glenview

The Village of Niles' claims that Glenview has acted fraudulently or breached its contract during the water war lawsuit were dismissed Tuesday. 

Cook County Chancery Court Judge Rita Novak threw out the former claim, while the later can be amended and refiled by Aug. 9, according to a press release from the Village of Glenview. 

Earlier:

"The judge now recognizes the issues and is asking us to delineate them in a clear manner, so she can more easily sort them out," said Niles Village Attorney Joe Annunzio.

"The case is not dismissed. It's not over by a long shot." Annunzio told Patch. "This is not a definitive ruling either way. It's part of litigation."

Meanwhile Novak also gave Niles until July 17 to "provide an affidavit stating all documents requested by Glenview in order to conduct an audit have been produced," the press release states.

The ruling is the first major update in the ongoing feud since April.

saying it was amending its lawsuit against Glenview so that it now seeks about $4 million in relief, and $1.84 million in punitive damages against Glenview.
